Terms of Service

The rules of the road for using ejswineshop.com and our services. We've tried to keep them plain — if anything's unclear, email cheers@ejswineshop.com.

Overview

These Terms of Service ("Terms") govern your use of ejswineshop.com (the "Site") and any services offered by EJ’s Wine Shop & Tasting Room ("we," "us," or "our"), including memberships, event ticketing, reservations, and in-store pickup orders.

By using the Site or any of our services, you agree to these Terms. If you don’t agree, please don’t use the Site. We may update these Terms from time to time — see "Changes to these Terms" below.

Age Verification

You must be at least 21 years of age to purchase alcohol from EJ’s. By using the Site or making a purchase, you represent and warrant that you are 21 or older and that all information you provide is true and accurate.

We reserve the right to refuse service to anyone who cannot provide valid government-issued photo identification at pickup, or who appears intoxicated. Alcohol will not be released to anyone under 21, and Iowa law requires us to verify ID at the point of transfer.

In-Store Pickup Only

EJ’s does not ship alcohol. All purchases are for in-store pickup at our location at 955 Washington Street, Dubuque, Iowa 52001. The Site allows you to browse our selection, hold bottles, and pay in advance — but every order must be picked up in person, by an adult 21 or older, with valid photo identification.

Pickup window

Orders are typically held for 14 days. After 14 days, we reserve the right to restock the bottles and refund the order, less a 10% restocking fee where permitted by law. We’ll reach out by email and phone before doing so.

Substitutions

Inventory rotates frequently. If a bottle you ordered sells out before pickup, we’ll contact you to suggest a substitution at the same or lower price, hold the order open until you choose, or refund the affected line item.

Memberships (Wine Club & Beer Club)

Wine Club and Beer Club memberships are sold as one-time, six-month commitments — they are not auto-renewing subscriptions. Payment is collected up front and covers the full term of the membership.

Pickup and forfeiture

Members are notified by email each month when their pickup is ready. Selections must be picked up by the end of the following month or they may be forfeited. We don’t hold more than one month of selections at a time.

Cancellations and refunds

Memberships are non-refundable once active. You may cancel future selections at any time — you’ll keep access to whatever you’ve already paid for through the end of the current six-month term, but no further pickups will be reserved. Contact us at cheers@ejswineshop.com to cancel.

Gift memberships

Gift memberships activate when the recipient creates an account using the email on the gift order, or 30 days after purchase, whichever comes first. Gifts are non-refundable once redeemed.

Event Tickets

Tickets to tastings, pairings, and other events are non-refundable but transferable. If you can’t make it, you’re welcome to send a friend in your place — just let us know the new attendee’s name in advance so we can update the list and check ID at the door.

If we cancel an event for any reason — weather, low turnout, illness — we’ll refund all ticket holders in full to the original payment method. Refunds typically post within 5–10 business days.

Attendees must be 21 or older. Photo ID will be checked at check-in. Anyone visibly intoxicated may be refused service in accordance with Iowa law.

Reservations

Backroom reservations

Backroom reservations (up to 25 people) are free and require admin approval. We aim to confirm or decline within 24 hours of the request. The space is held on a first-confirmed basis.

Full-shop reservations

Full-shop buyouts require a deposit at booking, with the balance due on the day of the event. Pricing is set at the time of inquiry. Deposits are refundable if you cancel at least 14 days before the date and forfeited for cancellations within 14 days.

No-shows and late arrivals

Reservations may be released after 30 minutes if your party hasn’t arrived and we haven’t heard from you. If you’re running late, please call (563) 239-9080 and we’ll do our best to hold the table.

Reviews & User Content

Logged-in account holders may post product reviews. By submitting a review or any other content, you grant EJ’s a non-exclusive, royalty-free, perpetual license to use, display, and reproduce that content on the Site and in marketing materials.

Reviews must be your own honest experience. Don’t post anything illegal, defamatory, or that you don’t have the right to post. We reserve the right to remove reviews that violate these Terms or that misrepresent a product or person.

Intellectual Property

The EJ’s name, logo, the wine-barrel mark, the script wordmark, photography, illustrations, copy, and the structure and visual design of the Site are owned by EJ’s Wine Shop & Tasting Room or our licensors. Product names and producer logos are the property of their respective owners and used here for product identification only.

You may not copy, redistribute, or create derivative works from Site content without our written permission. You may share links to public pages and quote short excerpts for non-commercial purposes with attribution.

Disclaimers & Limitation of Liability

The Site and our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Tasting notes, food pairings, and producer descriptions are subjective and provided for information only.

To the fullest extent permitted by law, EJ’s, our affiliates, and our staff will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services. Our total liability for any claim arising from these Terms or the Site will not exceed the amount you paid us in the twelve months preceding the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.

Governing Law & Disputes

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site must be brought in a state or federal court located in Dubuque County, Iowa, and you consent to the exclusive jurisdiction of those courts.

Most issues can be resolved without going to court. Before filing any formal action, please reach out to us at cheers@ejswineshop.com so we can try to work it out directly.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of the page reflects when changes took effect. If we make material changes — anything that meaningfully affects your rights — we’ll notify account holders by email.

Your continued use of the Site after the effective date of any update constitutes your acceptance of the revised Terms.
